DISCLAIMER

1. The 087 VoiP directory (hereinafter referred to as the “VoIP Directory”) is a national and international electronic VoiP directory accessed via the Internet , at the following web address www.call087.co.za. The VoIP Directory is available 24 hours a day, 365 days and allows users to search for VoIP number/s by entering keywords.

2. The user of this VoIP Directory acknowledges that:

2.1. the VoIP Directory is supplied on an “as is” basis and has not been compiled or supplied to meet the user’s individual requirements;

2.2. although the VoIP Service Provider/s uses their reasonable care and diligence to ensure that: (i) the data is accurate, correct, error- free and/or up-to-date; (ii) the data is available and/or accessible via the VoIP Directory, the VoIP Providers do not warrant, represent or in any way guarantee, either expressly or by implication that the data will be correct, error-free, up-to-date, complete, available and/or accessible via the VoIP Directory.

2.3. The VoIP Services Provider/s shall therefore not be held liable either jointly and/or individually under any circumstances, for any loss, damage, costs, expense or injury including without limitation direct, indirect, incidental, special, punitive, consequential loss, loss of profit, loss of anticipated savings, loss of goodwill, loss of revenue, loss of customers or clients arising in any manner whatsoever from:

2.3.1. the user’s access to and/or use of the VoIP Directory;

2.3.2. the data being incomplete, in accurate, or incorrect in any respect;

2.3.3. any mistake, omission, interruption, delay, error and/or defect whether human or mechanical including any failure or delay in the delivery of the VoIP Directory and/or the technology used to populate the data via the VoIP Directory;

2.3.4. any downtime, outage, interruption in or unavailability of the VoIP Directory including the data published in the VoIP Directory attributable to any cause whatsoever.

2.4. This disclaimer from liability applies notwithstanding the fact that the VoIP Services Provider/s may have been advised of the possibility of such loss or damage being incurred prior to its occurrence. The user is therefore encouraged to contact his/her own VoIP Service Provider directly to report any malfunction including any errors to his/her details which shall include without limitation incorrect, incomplete and/or outdated details

2.5. he/she will not be able to modify, update and/or remove his/her details from the VoIP Directory database and should he/she wish to make any modification, update and/or remove his/her details from the VoIP Directory, the user must contact his/her VoIP Service Provider directly. Upon receipt of this request, the VoIP Service Provider shall immediately make the changes.

2.6. He/she is encouraged to report untrue, defamatory, illegal, infringing and/or harmful data published on the VoIP Directory to the user’s VoIP Services Provider who will correct and/or remove such data or any part thereof upon receipt of proof of the allegation from a person reporting such matter.
